26 Nov Carry over of holiday pay and sickness
The current position on holiday leave is that a worker is entitled to accrue holiday leave whilst off sick. If a worker is on long term sick leave, he or she cannot be compelled by their employer to take holiday leave. Furthermore, if the long term sick leave goes over one leave year and into the next, up to four weeks’ accrued annual leave will roll over and the worker is then entitled to take those holidays in the next leave year. Whereas, a worker cannot be compelled to take holidays during a period of sickness, workers are entitled, if they so wish, to take holidays during a period of sickness.
