Discrimination cases – awards for injury to feelings

The case known as “Vento” is the leading case which sets down three bands of compensation for injury to feelings to be awarded if a Claimant is successful. On 5th September 2017, a Joint Presidential Guidance was issued which increased the bands for injury to feelings to the following.

  • A lower band of £800 to £8,400 (less serious cases).
  • A middle band of £8,400 to £25,200 (cases that did not merit an award in the upper band).
  • An upper band of £25,200 to £42,000, with the most exceptional cases capable of exceeding £42,000 (the most serious cases).

The above will apply to claims presented to the Employment Tribunal on or after 11th September 2017.
