Illegal workers

An employee who was paid a derisory sum to work as a live in house maid was entitled to bring claims for unfair dismissal and unlawful deductions from wages despite having no legal right to work. The employer argued that that contract was void for reasons of illegality as the house maid’s entitlement for leave to remain had expired. However, the Court of Appeal found in favour of the employee on the basis that the employee did not have the knowledge that she was not legally allowed to work.
