Employee dismissed whilst looking after wife with cancer

This firm (ELS Solicitors) represented Mr Andrew Ward who was dismissed whilst looking after his wife who was suffering from Grade 3 breast cancer. Mr Ward was pressured to attend face to face meetings with his employer (Arthur Branwell & Co Ltd) after being allowed to work from home on reduced hours. Arthur Branwell sent aggressive letters threatening him with disciplinary action and then dismissed him shortly after his wife had chemotherapy treatment. Mr Ward was successful with his claim for unfair dismissal and subsequently applied for legal costs against Arthur Branwell and their representatives recovering costs of £28,000 in part due to the nature of Arthur Branwell’s representative’s correspondence to ELS Solicitors, the language of which was found to be “bombastic and petty” by an Employment Tribunal.
