Feeling you are being subjected to bullying at work can be soul-destroying, whether it’s by a superior or a colleague. If you feel you are being treated in a manner that you find abusive, offensive, or malicious, it can be very upsetting.  

What counts as bullying at work?

There is no free-standing claim that can be brought at the employment tribunal for bullying, but it may fall into a category the employment tribunal can hear a case about. It could fall within one or more categories and these are some of the most common:

  • Constructive and unfair dismissal
  • Unlawful deduction from wages
  • Breach of contract
  • Refusal to allow time off for antenatal care
  • Prevention or attempted prevention to take parental leave
  • Being treated unfairly in connection with health and safety
  • Being treated unfairly for taking or seeking to take paternity leave or ordinary or additional adoption leave
  • Breach of flexible working regulations
  • Failure to provide equal pay to the opposite sex
  • Less favourable treatment of a part-time worker than a full-time employee
  • Being treated unfairly for reasons connected with pregnancy, maternity, or childbirth.
  • Being treated unfairly on the ground of making a protected disclosure (whistleblowing)
  • Discrimination on the ground of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex or sexual orientation
